General Terms and Conditions

1. Applicability and scope
The following general terms and conditions (hereinafter referred to as "GTC") apply to all business relationships between Osteopathie Denk GmbH (hereinafter referred to as "us" or "we") and the customer (hereinafter referred to as "customer" or "you") for services (hereinafter referred to as "service(s)") provided by us.

Individual agreements concluded with the customer take precedence over these GTC. Conflicting conditions of the customer are not recognized.
Osteopathie Denk GmbH reserves the right to change these GTC at any time. All changes become effective upon publication of the new GTC on the website. The decisive point in time for the applicability of the valid GTC is the time of the binding appointment for the provision of the service.
Please read these terms and conditions carefully before making an appointment with us. By making a binding appointment, you agree to the following conditions and our privacy policy.
2. Offer and prices
Our offer and prices correspond to those stated on the website and in the practice. All prices are stated in CHF (Swiss francs).
Osteopathie Denk GmbH reserves the right to change its offers and prices at any time. The offers are subject to change and are not to be understood as a binding offer.
Osteopathie Denk GmbH cannot guarantee that the services listed are available at the time the service is provided. Therefore, all information on the services is without guarantee and can change at any time and without notice.
3. Payment options
The following payment options are generally available to the customer for the purchase of our services:
- Bank transfer, credit card or debit card.
By choosing the payment method, the customer authorizes the payment either by entering the credit card details or access data of a payment service provider.
The customer authorizes Osteopathie Denk GmbH to collect or collect payments in the appropriate way. Should there be chargebacks, Osteopathie Denk GmbH is entitled to reimbursement of the associated costs and bank processing fees.
Osteopathy Denk GmbH reserves the right to change the payment options offered at any time.
4. Appointment arrangement/conclusion of contract
Appointments can be made via our online reservation system, by telephone or by email. The contract for the provision of services is concluded with our confirmation of acceptance of the appointment by email or telephone. Osteopathie Denk GmbH reserves the right to cancel or postpone an appointment due to unforeseen circumstances (e.g. illness of staff) without incurring any costs or compensation.
5. Failure to attend the appointment
If the customer does not attend the agreed appointment for whatever reason, he must cancel it by phone or email at least 24 hours before the service begins. A delay of 45 minutes is considered failure to attend the appointment. Otherwise, Osteopathie Denk GmbH reserves the right to invoice the booked service in full (at least the amount of CHF 159), unless the customer can provide proof by means of a doctor's certificate that he was neither able to attend the appointment nor cancel it in time.
6. Liability
Osteopathie Denk GmbH excludes any liability, regardless of its legal basis, as well as claims for damages against Osteopathie Denk GmbH and any auxiliary persons and vicarious agents. In particular, Osteopathie Denk GmbH is not liable for indirect damage and consequential damage, loss of profit or other personal injury, property damage and purely financial loss of the customer. Further mandatory statutory liability remains reserved, such as for gross negligence or unlawful intent.
Event outside our sphere of influence
If an event occurs that is outside our sphere of influence and control (so-called force majeure), we assume no liability or responsibility for the non-fulfillment or delayed performance of any obligations arising from these General Terms and Conditions and the contractual relationship based on them. An event outside our sphere of influence includes, for example, strikes, fire, explosions, storms, floods, earthquakes, epidemics or pandemics. If an event occurs outside our control that affects the performance of our obligations under the contract, we will notify you as soon as possible.

Osteopathie Denk GmbH collects and processes personal data only within the framework of the statutory provisions, in particular in compliance with the applicable data protection laws. 8. Copyright
The information and content published on the website are protected by copyright and are the property of Osteopathie Denk GmbH or the respective rights holder. Reproduction, processing, distribution or any other form of exploitation require the prior written consent of the respective rights holder. Osteopathie Denk GmbH and the respective rights holder expressly reserve all rights in this regard.
9. Severability Clause
If any of the provisions of these Terms and Conditions are or become illegal, invalid or unenforceable for any reason, this shall not affect the validity of the remaining provisions. Unless otherwise agreed, the invalid provision shall be deemed to be replaced by a valid provision that takes the economic purpose of the provision and the will of the parties at the time the contract was concluded as far as possible into account. The same applies to any gaps in these Terms and Conditions.
10. Applicable law and place of jurisdiction
These terms and conditions, the contractual relationships based on them and any disputes are subject exclusively to Swiss law.
The place of jurisdiction for natural persons is the registered office of Osteopathie Denk GmbH or the customer's place of residence. For legal persons, the registered office of Osteopathie Denk GmbH is the sole place of jurisdiction.
11. Changes
These Terms and Conditions may be changed from time to time without prior notice. Any changes to these Terms and Conditions will apply when posted on the Website, unless otherwise stated.
